Treatment Outcomes Under Prop 36
Since early April, hundreds of defendants charged with drug-related offenses under Prop 36 have gone through probation and treatment screenings. The data shows that only five defendants declined services—meaning over 92% entered probation programs or court-mandated treatment.
This strong participation rate reflects Prop 36’s emphasis on rehabilitation alongside accountability, addressing the underlying issues that fuel repeated criminal behavior.
Relief for Local Businesses

Small and large retailers across San Diego County are reporting a noticeable impact from the repeat theft offender provisions of Prop 36. With stricter penalties in place, businesses that were once frequent targets say they are beginning to feel a renewed sense of security for both their employees and customers. Businesses can now request complimentary window decals from the District Attorney’s Office to display as a visible deterrent, signaling that repeat theft will be prosecuted under Prop 36.
DA Stephan highlighted the balance between public safety and treatment:
“We’re already seeing promising evidence that Prop 36 is restoring the rule of law, giving hope to businesses suffering the specter of repeat theft that has threatened the safety of employees and customers. By emphasizing accountability alongside treatment and rehabilitation, data also shows the law is working to address the core drivers of habitual criminal behavior.”

As of July 31, 2025, the District Attorney’s Office reports:
- 1,778 cases charged under Prop 36 provisions
- Cases include repeat theft offenders charged under Penal Code section 666.1 and repeat hard drug offenders charged under Health and Safety Code section 11395.
